If you are in another country than your country of citizenship, you should claim your refugee status there. The United Nations will decide your safe country to flee.
If you have family or friends in Canada and they can sponsor you, they can apply under a group of five to sponsor you to immigrate to Canada.
If you come to Canada and you want to claim your refugee you should claim your refugee at the Canada border or inside Canada.
Convention refugee or a person in need of protection is a person who lives outside of their home country and they’re not able to return to their country because of a fear of persecution based on
● race
● religion
● political opinion
● nationality
● being part of a social group, such as women or people of a particular sexual orientation
A person in need of protection is a person in Canada who can’t return to their home country safely because, if they return, they may face
● danger of torture
● risk to their life
● risk of cruel and unusual treatment or punishment
Claim refugee protection from inside Canada
There are two ways for a person who wants to claim their refugee in Canada.
1-At a port of entry, when a person arrives in Canada
2-online within Canada
When a person makes their claim, they can request a work permit simultaneously.
Make a claim when arriving in Canada
A person who wants to claim their refugee can claim a port of entry (airport, seaport, land border), and an officer will ask some questions to clarify why the person wants to be a refugee and collect the identification documents.
The officer would decide to give a refugee claimant : a refugee protection document, a confirmation of referral letter ,basis of claim form or a medical examp instruction.
Submit the claim online from inside Canada
A person who is already in Canada and wants to claim their refugee must Submit their claim in the IRCC portal.First they should get an invitation code and then Sign up for a portal account
Canada’s response to the emergency situations
Canada immigrates in some international situations, in devoting special programs.
For example since 2020, they initiated a program to aid Afghan civilians in coming to Canada for their safety. Also, in March 2021, Canada has initiated the CUAET program for Ukrainians and their family members come to Canada for asylum.
